In response to demographic changes and the vagaries of doing business in a global economy, several legislatures and amendments have been passed by the Government. Among these are the amendments to the Employment Act in relation to the coverage, maternity protection and benefits, childcare leave and pro-rating of sick leave. Accompanying these are several guidelines augmented by the Tripartite bodies in relation to Fair Employment practice, management of excess manpower and the re-employability of older workers. Employers need to be mindful of their duty of care and not violate the law of the land. This 2-day workshop is intended to provide participants with an insight into the pertinent sections of the Employment Act which are relevant to an employer's rights and responsibilities. Key Topics 1. The rights and responsibilities of an employer 2. Tripartite guidelines on fair employment practice 3. Who is covered under the Employment Act - Misnomer of salary as benchmark 4. Contract of service vs contract for service 5. Definitions in relation to basic rate of pay, gross rate of pay, contractor and employee 6. Illegality of terms of contract of service 7. Termination/dismissal for cause or otherwise - When it's deemed unfair 8. Breach of contract and an employer's recourse 9. Transfer of employment vs outsourcing - employee's rights and opportunities 10. Employer's obligations to pay salary upon termination and approved deductions 11. Application of Section 35 in relation to Part IV of Employment Act on rest days, hours of work and other conditions of work 12. Defining rest day and the difference between rest day and off day 13. Mandatory hours of work and when hours of work may be varied 14. Quantum of and basis of annual leave entitlement and an understanding of off-setting against notice period 15. Retrenchment - Criteria and the Tripartite guidelines on the capping of retrenchment benefits in conjunction with the Tripartite guidelines on the management of excess manpower 16. Re-employment of Older Workers - Planning and preparing employees for re-employment, the re-employment contract, EAP 17. Annual wage supplement - Whether it constitutes an employee's total compensation and whether it can be denied or varied 18. Maternity protection and benefits - female employee's rights in relation to quantum and basis of consumption of such maternity leave 19. Employer's responsibility in not discriminating a female employee under Section 81, 84 and 84A 20. Childcare leave - quantum and basis in relation to managerial and non-citizen employees 21.
