WIPO-IPOS Mediation Seminar: Win-Win in IP Disputes

About this Course

Mediation offers several advantages for the resolution of intellectual property disputes. It is an attractive option for parties who seek to maintain control over the dispute resolution process and outcome. Parties can retain confidentiality and reach a speedy settlement without damage to reputation. Importantly, it can preserve and even enhance the relationship between parties. Especially for IP practitioners faced with the reality of proceedings in several jurisdictions, mediation is a real option to be considered.

Join us for a panel discussion with representatives from the WIPO Arbitration and Mediation Center, the Singapore State Courts Centre for Dispute Resolution, Singapore International Mediation Centre (SIMC) users of mediation, mediators and counsel to give different perspectives on mediation for IP disputes.  From the user's perspective, what are the considerations for choice of dispute resolution mode? From the lawyer's perspective, what are the differences in experience and outcomes between mediation and IPOS adjudication? From the mediator's perspective, what is needed to achieve win-win? Participants will also gain valuable insights from the State Courts as they share their experience on structuring mediation as the primary dispute resolution mode.  SIMC will add their views on mediation generally and the benefits of Singapore as a venue for mediating multi-jurisdictional disputes.

If you or your organization owns or uses IP, you can better understand how to optimise your approach to dispute resolution.  If you represent your clients or organisation in IP and technology disputes, you will learn how to better advise your clients from the outset and achieve an effective and efficient resolution. Professionals with an IP background interested in helping parties reach settlement through mediation can also find out more about becoming a member of the WIPO Arbitration and Mediation Center's Panel of Neutrals.
